Dispute Resolution Services

An overview of the options we offer, who can access us, and how our process works.

Overview

IGET offers a range of dispute resolution options specifically designed for the global video game and esports industries. The appropriate method depends on the nature of the dispute and, in some cases, the preferences of the parties involved.

If you are considering bringing a matter to IGET, please take into account the various factors that may influence the process and your options for resolution.

Benefits of ADR

The primary advantages of ADR are efficiency and cost-effectiveness. Traditional litigation can be slow, involving multiple court appearances and high legal fees. ADR methods streamline the resolution process, reducing the time and expense required to settle disputes. Additionally, ADR offers more flexibility, allowing parties to choose neutrals with specific expertise in the subject matter, ensuring more informed decisions.

Who Can Access Our Services

IGET’s dispute resolution services are available to individuals, teams, organizations, publishers, and other businesses operating in the global video game and esports sectors. Parties to a dispute may access IGET services when all parties agree for IGET to hear the dispute. This typically occurs under two scenarios:

  1. Where there is a model IGET arbitration and mediation clause in an existing agreement between the parties, or
  2. The parties enter into a specific agreement to use IGET for their dispute, once the dispute has arisen.

Accessing Our Services

IGET offers a variety of dispute resolution methods depending on the nature of the dispute. These options include:

  • Mediation – A voluntary process in which a neutral mediator helps the parties negotiate a mutually acceptable settlement. Unlike arbitration, the mediator does not make a binding decision, but facilitates communication to help the parties reach an agreement.
  • Arbitration – A formal dispute resolution process where both parties agree to submit their dispute to one or more arbitrators. The arbitrators render a binding arbitral award, much like a court judgement, but the process is private and typically quicker. It is enforceable almost everywhere in the world.
  • Expedited Arbitration – A faster version of traditional arbitration, designed for cases that require swift resolution. The process is condensed, with shorter timelines and fewer procedural steps, leading to a quicker outcome.
  • Expert Deterimination – The parties appoint an independent expert to decide specific technical or factual issues. This method is particularly useful in disputes involving specialised knowledge, where an expert can resolve the matter based on their expertise.

ESIC Appeals Process

For our ESIC appeals division and esports anti-doping matters, arbitration is mandatory. Other types of disputes can be resolved using any of the methods mentioned above, depending on the preferences of the parties and the specifics of the case.
